Jacob is on trial for the murder of Jackson who died from a single blow to the head.
Jackson was punched outside a hotel in St Kilda. A witness, Jasmine, saw Jacob punch Jackson in the face and fall to the road. Jasmine further claims that Jacob yelled “Who is next!?” following the punch.
The following is a transcript of the cross-examination of Jasmine by counsel for the defense:
Q: You have a very good memory of these events, which occurred almost two years ago. Can you tell the court whether you made a record of your observations of that night?
A: I made written notes at the time and compiled a more detailed report when I returned to the station 4 or 5 hours later that night.
Q: And have you had an opportunity to read over the notes and the report?
A: I read over the notes yesterday.
Q: I put it to you that you have no real recollection of the events of that night and have simply memorized the contents of your report.
A: Well it happened so long ago- No- I cant say that I have any real memory of it at all. But my statement was quite accurate. I read over it and signed it after I wrote it.
Q: Your Honour, I call for the witness written report.
